1. Agreement
By using www.efort.org and www.portal.efort.org you agree to the terms of use of this agreement. EFORT reserves the right to change these terms from time to time. We will always post a notice of those changes, and the date they become effective within the www.efort.org and www.portal.efort.org websites. You may view the current version of this “Terms of Use Agreement” at any time through a link at the bottom of each page within the www.efort.org and www.portal.efort.org websites.

2. Description of Service
www.efort.org and www.portal.efort.org consists of three parts:
a “physician-facing (members zone)” site,
a “patient-facing” site and publicly accessible pages.

The physician-facing site includes functions and services designed for members of National and Speciality Societies, embedded in the EFORT Federation. All information contained within this part of the site is intended only for state-licensed physicians or medical students. As a physician, you should use your own professional judgment in evaluating the information provided through this web site.

The patient-facing site allows each state-licensed physician member to create a web site that patients and the public may view. Your patient-facing site may include information you provide and additional content, such as patient education material, provided by EFORT or others. This site is in no way intended to serve as a substitute for your medical diagnosis or treatment.

3. Representation
As a user of www.efort.org and www.portal.efort.org, you are liable for the accuracy of the information that you provide on your patient-facing site, such as your professional qualifications and practice characteristics.

4. Registration and Privacy
Please refer to EFORT’s Privacy Policy for information on how we protect your personal information.

5. Third Party Content
www.efort.org and www.portal.efort.org contains information provided by third parties. The site also provides links to other websites. Although EFORT uses protocols and review processes for the content posted on www.efort.org and www.portal.efort.org, we assume no responsibility for information provided by third parties or for the content on other Internet websites to which we provide links. EFORT is a distributor (and not a publisher) of content, supplied by third parties and EFORT members. Accordingly, EFORT has no more editorial control over the portal content than a public library, bookstore or newsstand has.

6. Advertising
Sponsors may advertise their products and services on your physician-facing site.

At no time does EFORT make any representation or warranty regarding any sponsor’s products or services, nor will we be liable for the sponsor’s products or services.

7. Disclaimer of Warranties
EFORT has taken reasonable measures to ensure that the information contained within www.efort.org and www. portal.efort.org is reliable, however, by using this web site, you accept the products and services provided here “AS IS”. EFORT makes no express or implied warranty regarding the accuracy, content, completeness, reliability, operability, or legality of information contained within www.efort.org and www.portal.efort.org, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

8. Consequences
If you violate the terms of this agreement and cause harm to others, you agree to i ndemnify and hold EFORT, its sponsors and vendors harmless from and against any and all loss, damage, or expense.

9. Participation
EFORT may accept or reject your registration and participation in this service for any reason at its sole discretion, including the suspension or deletion of your access data. www.efort.org and www.portal.efort.org is offered as an exclusive benefit for members of Speciality and National Societies of the EFORT Federation. Should your membership in one of these societies lapse for any reason, your access data may be deleted and your patient-facing website may be taken off-line.

10. Intellectual Property
Copyright, trademark, and other intellectual property laws apply to the materials on www.efort.org and www.portal.efort.org.

11. Privacy Rights of Patients
Your www.portal.efort.org site may enable you to transmit, store, and/or receive confidential patient information. International, European and national laws and regulations, as well as ethical and licensure requirements may impose patient confidentiality obligations that affect your ability to make use of these services or to transmit certain information to third parties. You must comply with laws that govern the gathering, use, transmission, processing, receipt, reporting, disclosure, maintenance, and storage of patient information. You also are solely responsible for obtaining patient consents and any other consents or permissions required for the patient information you transmit, store, or receive in connection with www.portal.efort.org.

You agree that EFORT and other persons or entities may act on your behalf to monitor, retrieve, store, and/or use patient information exclusively in connection with the operation of www.efort.org and www.portal.efort.org services. EFORT agrees to use commercially reasonable efforts to maintain the confidentiality of patient information and prevent its disclosure to others except in connection with the transmission, storage, retrieval, and disclosure of such information on your behalf and as may be required or permitted by law.

12. Restricted Access
Your physician-facing www.portal.efort.org site is accessible only by means of a username and password. You agree that you are solely responsible for maintaining the strict confidentiality of the username and password. You agree to notify the portal administration of any unauthorized use of your username and password.

13. Complete Agreement
If any provision or provisions of this agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect. This agreement constitutes the entire agreement between the parties pertaining to its subject matter and supersedes any earlier agreements, memoranda, or understandings. It may not be modified except as described elsewhere in this agreement. Anything in www.efort.org and www.portal.efort.org program inconsistent with or conflicting with the terms of this agreement is superseded by the terms of this agreement.
